Accordingly, this Site owns the copyright in all information or materials provided here unless stated otherwise. No material from this Site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any manner or form except as explicitly provided below. Modification of the materials or use of the materials for any purpose other than those purposes explicitly permitted below is a violation of Peddler's Wagon's copyright and/or other proprietary rights. CONTENT

PRODUCT DETAIL

Description- Products are described as accurately and appropriately as possible in order to ensure that a customer understands the product they are ordering.

Color- Colors are represented as realistically as possible, but color variations of product images or color swatches are outside of the control of Peddler's Wagon because software, hardware and Internet connections can alter the appearance of colors.

CORRECTIONS

While we make every effort to ensure the accuracy of product and price information, errors do occasionally occur. We reserve the right to correct any errors or inaccuracies at any time. We apologize for any inconvenience this may cause. If you are not completely satisfied with your purchase, you may return it for a refund.

YOUR ACCOUNT

The user is responsible for maintaining the confidentiality of information that could be used to access your account such as user id and password, and the user agrees to accept all responsibility for all activities performed using your user id and password. Additionally, the user is responsible for restricting access to your computer and not using public computers to access your account.

The Site does carry products for children, but only sells those products to adults with credit cards. If you are under 18 you may use the Site only with the approval and active involvement of a parent or guardian.

Some product or content on the site might be deemed inappropriate for people under the age of 18 or those easily offended. Those people should not use the Site.

RISK OF LOSS

All items purchased from the Peddler's Wagon are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Under no circumstances, including, but not limited to, negligence, shall Peddler's Wagon be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in this Site, even if Peddler's Wagon or a Peddler's Wagon authorized representative has been advised of the possibility of such damages. APPLICABLE LAW; CONTRACT INTERPRETATION

Peddler's Wagon's principal place of business is in California and Peddler's Wagon operates this Site from its office in California. The laws of the State of California apply to this Agreement, without regard to conflicts of laws principles. If any provision of this Agreement is ruled to be unlawful, void, or otherwise unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between you and Peddler's Wagon relating to the subject of this Site.

INDEMNITY

You agree to defend, indemnify, and hold harmless Peddler's Wagon, its officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of this Site or your breach of the terms of this Agreement. Peddler's Wagon shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

DISPUTE RESOLUTION

Any dispute arising with respect to this Agreement shall be resolved by negotiation between the parties or, if necessary, by resort to an appropriate federal or state court located in Sacramento, California. You expressly waive and are estopped from asserting any right to pursue any claim against Peddler's Wagon relating to this Agreement in any forum or venue located outside of Sacramento, California, in the event of the filing of any such claim, you stipulate to the transfer of the filing to any appropriate or available forum or court in Sacramento, California, at Peddler's Wagon sole discretion.

Peddler's Wagon collects the following information from customers that order from the site: name, shipping address, billing address, e-mail address and credit card information. This information is collected in order to fulfill orders placed online. On occasion, epeddlerswagon.com may become involved in a marketing alliance with a like-minded company where epeddlerswagon.com may host a co-branded shopping page on the site. The names and information provided by registered peddlerswagon.com customers who purchase from this co-branded page may be shared with this associated sponsor, if they indicate they wish to share their information with selected partners (on our "My Account" page).
